Brief Program Description: The HIPAA Privacy Rule places restrictions and requirements on the use and disclosure of protected health information (PHI). Where a covered entity (including a physician or a hospital) conducts clinical research involving PHI, it is important that the investigator, IRB and institution all understand the Privacy Rule’s restrictions on the use and disclosure of PHI for research purposes. This presentation will provide a brief overview of the HIPAA Privacy Rule and the relevant definitions as well as the special implications related to research, including the requirements for HIPAA compliant authorizations and what exceptions apply to those rules. The presentation will also provide a description of the roles of the involved parties, including the researcher, institution and IRB. Finally, the presentation will provide real-life examples of HIPAA’s impact on clinical research.
Program Objectives:
- Define what is HIPAA
- Explain HIPAA’s impact of Clinical Research (from protection of participant PHI to waivers of authorization)
- Understand the roles of each party (IRB, institution, investigators) in ensuring HIPAA compliance during clinical research
